Should you disagree with any portion of these Terms, you must refrain from using novapack Store's website, application, and services. Any individual who accesses our services on behalf of a company or other legal entity affirms that they hold the authority to bind that entity to these Terms.

Use of the Website

You agree to use novapack Store's website, application, and services solely for lawful, personal, non-commercial purposes, unless novapack Store has granted you explicit written authorization to do otherwise. When using our platform, you must not:

• Submit fraudulent, excessive, or malicious orders, including orders placed without any genuine intent to receive the goods
• Resell novapack Store products for commercial purposes without obtaining our express written consent

Product Information and Pricing

novapack Store works diligently to keep product descriptions, prices, specifications, and availability details accurate and current. Should an error arise concerning product information, pricing, or availability, novapack Store may correct the mistake and cancel any orders placed on the basis of that incorrect information, at no cost to you. For products with natural variability — such as handmade items or goods made from natural materials — minor differences in dimensions, weight, or appearance from the listed specifications may occur. Product details and warnings are supplied for reference purposes only, and novapack Store cannot guarantee that products are entirely free from cross-contamination during processing or packaging. Availability may differ depending on your delivery zone, chosen pickup location, and selected time slot.

Orders and Payment

Every order is contingent upon product availability and acceptance by novapack Store. novapack Store may decline or cancel any order at its sole discretion, including orders that appear fraudulent, breach these Terms, or cannot be fulfilled because of stock shortages. Full payment is required before an order is dispatched or collected, unless novapack Store agrees otherwise in writing. Minimum order values and delivery fees may apply depending on your selected delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age requirement for purchasing such items in your jurisdiction, and valid government-issued identification will be requested at the time of delivery or pickup. Should an item in your order be unavailable, novapack Store will contact you before dispatch and may propose a suitable substitute or refund the unavailable item, unless you have opted out of substitutions during checkout.

Intellectual Property

All content made available on novapack Store's platforms — including text, images, logos, software, private label product packaging, and the "novapack Store" name and branding — belongs exclusively to novapack Store and is safeguarded by applicable copyright, trademark, and intellectual property laws of the United States. You may not reproduce, distribute, modify, or create derivative works from any novapack Store content without obtaining our express written permission. User-generated content (including product reviews, photos, and comments) that you submit to our platforms may be used by novapack Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must promptly inform novapack Store of any unauthorized use of your account or any other security breach. You are likewise responsible for supplying accurate, current contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you provide are truthful and complete. If you place an order on behalf of a third party, you bear sole responsibility for confirming that the third party satisfies all legal eligibility requirements for the purchased products, including age restrictions applicable to restricted goods.

Limitation of Liability

To the maximum extent permitted by law, novapack Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our website, products, or services, including but not limited to damages for incidental loss or delivery delays. novapack Store's total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services at issue. novapack Store is not responsible for service failures or delays caused by circumstances beyond our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of novapack Store's services shall first be submitted to novapack Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

novapack Store may update, modify, or replace any portion of these Terms at any time at its sole discretion. Where we make material changes to these Terms, we will give at least 30 days' advance notice by email to the address associated with your account, or by posting a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using novapack Store's services before the effective date of the changes.
